Concerned about threat to Charlbury events

Dear Mr. Hofman

I attach the licence details as previously posted. I am sure you have a copy. I think for all concerned point 6 is relevant. The safety advisory group will set noise levels for all events, with three months notice from the estate or organiser. I feel that this independant group is the best group to have responsibility, not the event organiser or individuals in the local community. Can you repost on the forum why you feel this safeguard is inappropriate, and you feel the need to use a legal challenge to pursue your personal agenda, at considerable cost to the public purse?

"Having considered all representations made in writing and at the hearing and all other relevant considerations, the Panel decided to approve in part the application as set out in the operating schedule, more particularly by approving the application subject to the following conditions:

(1) Licensable activities will be limited to events held at the premises and will not be for general use.

(2) Events will be limited to:

(a) Three events per annum where the proposed capacity exceeds a maximum attendance of 5000 people with no more than two events to finish after 20:00. (In respect of any third event, the hours during which the premises shall be open to the public shall be from 10:00 until 20:00); and in addition

(b) Ten events per annum where the proposed capacity is less than a maximum attendance of 5000 people (at no more than five of which shall provision be made for amplified music). Where provision is made for amplified music it shall cease at Midnight.

(3)(a) For the purposes of this application at (2)(a) above an 'Event' shall mean a period not exceeding 3 consecutive days which may, for Outdoor Concert events, be preceded by a fourth day when the licensable activities may take place with the exception of regulated entertainment in the Main Arena.

(3)(b) For the purposes of this application at (2)(b) above an 'Event' shall mean a period not exceeding one day (24 hours). Two consecutive days (48 hours) shall be allowed and count as two events.

(4) For music events where the capacity is expected to exceed 5000, a designated 'Main Arena' shall be identified and the hours of regulated entertainment in the Main Arena will be limited to 10:00 to 23:00 on each day of the event (with the exception of a preceding fourth day when regulated entertainment cannot take place in the Main Arena).

(5) Any 'fairground' entertainment at all events irrespective of size, shall cease at 23:00. Arrangements for the use of PA systems (except in the event of an emergency) shall be approved by the Safety Advisory Group.

(6) Details of all events shall be submitted to the Safety Advisory Group (SAG) at least three months in advance of the proposed event and the annual cumulative impact of noise upon the settled community will be a factor when deciding noise limits for each event.

General Conditions to Apply to All Events

(7) The Premises Licence Holder must notify the Licensing Authority at least three months in advance of the proposed event.

(8) The Premises Licence Holder will liaise with the Safety Advisory Group (SAG) appointed by the Licensing Authority and shall comply with the requirements of that Group.

(9) The Premises Licence Holder must notify the Licensing Authority at least three months in advance of the proposed event of historical and estimated attendance figures for the proposed event.

(10) The Premises Licence Holder must notify the Licensing Authority at least two months in advance of the proposed event of the proposed measures that will be taken to reduce the impact of activities upon the Licensing Objectives.

(11) At least three months in advance of the proposed event, the Premises Licence Holder shall submit a traffic management policy to be agreed with the Licensing Authority, Oxfordshire County Council, and Thames Valley Police, which takes into account the arrival and dispersal of trade stands and all other ancillary infrastructure associated with events.

In reaching its decision the Panel considered the above conditions to be appropriate, necessary and sufficient to ensure that the licensing objectives are met."
